1. Parties, Definitions, and Interpretation

In these terms and conditions (“Terms”), “Customer” refers to the client for whom CS Property Services (“CS Property”) is to carry out work. “Contract” means the agreement between the Customer and CS Property for the performance of work under these Terms. “Works” refers to the services detailed in CS Property’s estimate, work detail sheet, or any other document or email issued by CS Property, as may be modified in writing.

2. General

2.1 The Customer is categorized as either an Account Customer or a Non-Account Customer at CS Property’s discretion.

2.2 All estimates, orders, and instructions are subject to these Terms, overriding any Customer terms unless a signed agreement states otherwise.

2.3 No modifications shall be effective unless agreed upon in writing.

2.4 These Terms do not confer any third-party rights under the Contracts (Rights of Third Parties) Act 1999.

3. Price, Estimates, and Variations

3.1 Unless a written estimate is provided and accepted, all Works will be charged according to CS Property’s standard rate card.

3.2 Estimates remain valid for 28 days unless withdrawn earlier.

3.3 Estimates are fixed unless:

  • Information provided by the Customer is incorrect or incomplete, necessitating adjustments.
  • A price increase of over 10% in materials or services occurs before work begins, in which case a revised estimate will be provided.

3.4 A collection fee of £50 plus VAT applies for non-standard stock items unless otherwise included in the estimate.

3.5 The standard rate card is available on CS Property’s website and premises.

3.6 All prices are exclusive of VAT unless stated otherwise.

3.7 Diagnostic work leading to the replacement of faulty components will be charged separately.

3.8 A markup of up to 65% may be applied to parts and materials.

4. Payment and Title

4.1 Non-Account Customers: Payment is due upon completion of the Works.

4.2 Account Customers: Invoices are due within 30 days of issue.

4.3 If snagging applies, 95% of the invoice must be paid upon completion, with the remaining 5% due once snagging is finalized or within 14 days if access is not provided.

4.4 If the Customer’s representative (e.g., agent or tenant) fails to pay, the Customer remains liable.

4.5 Late payments incur interest at 4% above the Bank of England base rate and additional collection costs.

4.6 Certificates, guarantees, or documentation will only be issued after full payment is received.

4.7 Ownership of materials remains with CS Property until full payment is made.

5. Works Description

Illustrations and descriptions in marketing materials are for general guidance only and do not form part of the Contract.

6. Commencement and Completion

Dates for work commencement and completion are estimates only. CS Property is not liable for delays due to unforeseen circumstances.

7. Permits, Licences, and Access

7.1 The Customer is responsible for obtaining necessary permits unless otherwise agreed.

7.2 A safe working environment must be provided. CS Property personnel will not enter properties occupied only by minors.

7.3 The Customer must provide power and clean water for CS Property’s use.

7.4 For drainage work, plans should be provided; additional charges may apply for tracing unidentified drains.

7.5 The Customer must obtain permissions to access third-party property and indemnify CS Property against any claims arising from such access.

7.6 Fixtures and fittings in working areas must be removed by the Customer before work commences. CS Property may remove them at the Customer’s expense but is not liable for any damage unless due to negligence.

8. Frozen Pipes

CS Property is not liable for fractures in frozen pipes or for clearing blockages in frozen systems.

9. Waste Removal

Unless agreed otherwise, waste material disposal is the Customer’s responsibility.

10. Force Majeure

CS Property is not liable for delays or failure to perform due to events beyond its control, such as strikes, extreme weather, or other unforeseen circumstances.

11. Inspection and Complaints

11.1 The Customer must inspect the Works upon completion and notify CS Property in writing of any issues within 7 days.

11.2 If a defect is found, CS Property must be given reasonable time to rectify it before involving third parties. Failure to do so voids any claim against CS Property.

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
